The following Terms and Conditions apply to transactions between homeowners, property owners, or any individual or entity contracting for products or services (individually, “Customer,” and collectively, “Customers”) and Icon Roofing LLC (“Icon”). Customers agree to these Terms and Conditions by signing an estimate, accepting an Icon bid, or allowing or requesting Icon to begin work on a project. Customers also agree to these Terms and Conditions when an Icon bid is incorporated by reference into a subcontract.
1. Acceptance
Icon conditions its acceptance of any Customer order or agreement on the Customer’s acceptance of these Terms and Conditions. These Terms and Conditions supersede any additional or different terms in a Customer’s order, subcontract, other document or communication. A Customer’s acknowledgment of any Icon estimate, or acceptance of service, is conclusive evidence of the Customer’s agreement to these Terms and Conditions.
2. Scope of services
Services are project based and depend on each Customer’s needs. Icon provides a range of services, including but not limited to:
- New roof installation services
- Roof replacement services: tile, shingle, and flat or foam roofing
- Roof repair services: tile, shingle, flat or foam, and metal roofs
Unless otherwise stated in writing, the Customer is solely responsible for determining whether the work the Customer orders is adequate and sufficient for the Customer’s intended purpose. In performing its services, Icon may rely on the work of third parties, the representations of the Customer and the public record, and has no obligation to verify any of them.
3. Customer types and payment terms
The Customer shall pay all required deposits when the project is accepted. The Customer acknowledges that Icon will not order materials or schedule services to begin before the deposit is paid. Additional payment terms depend on the type of Customer and the services required.
3.1 Single-transaction Customer
Before any service is scheduled and before the project begins, an initial deposit of 50% of the total project amount is required. The remaining 50% balance is due when the project is complete.
3.2 Reoccurring Customer
For reoccurring Customers, including contractors with ongoing or repeated projects, payment is due when each project is complete. Full payment is expected within three (3) days of project completion. To meet business needs or circumstances, these terms can be extended to fifteen (15) or thirty (30) days after project completion, but only after a written request is delivered to and approved by Icon.
4. Change orders
Any change or adjustment the Customer makes to the project after accepting it is subject to Icon’s approval, and may result in price increases, changes to the installation date and manufacturing delays.
5. Default
A Customer is in default for invoices not paid within 30 days, or as otherwise stated in the invoice terms. Icon charges 1.5% per month on overdue amounts. In the event of default, the Customer also agrees to pay all service charges assessed against the Customer, plus all actual attorney fees and collection costs Icon incurs to enforce these Terms and Conditions or to collect money from the Customer. The Customer agrees that time is of the essence.
6. SMS terms and conditions
6.1 Consent for SMS communications
When you consent to receive SMS communications from Icon Roofing LLC, you agree to receive messages related to your services or interactions with us. Your phone number and consent will never be shared with third parties or affiliates for marketing purposes. Your information is used only to communicate with you about our services.
6.2 Types of SMS communications
If you have consented to receive SMS messages from Icon Roofing LLC, you may receive text messages about:
- Customers and guests: Appointment reminders, updates about ongoing or completed roofing services, and billing inquiries.
- Job applicants: Updates on your job application status, interview scheduling and onboarding materials.
Examples of SMS messages you may receive:
- “Hi Alex, this is Icon Roofing. You are confirmed for Wednesday, December 1, 2024, 11am to 1pm.”
- “Hi Alex, this is Icon Roofing. Confirming your project scheduled for Monday, December 1, 2024. Please call (480) 427-7600 with any questions or visit iconroofingaz.com.”
- “Hi Alex, Icon Roofing. Trevor is en route. ETA 20 to 30 mins.”
6.3 Standard messaging disclosures
- Message frequency may vary.
- Standard message and data rates may apply according to your carrier’s plan.
- You can opt out of receiving messages at any time by texting “STOP.”
- For assistance, reply “HELP” or contact us directly.

6.4 How to opt in
You may opt in to receive SMS messages from Icon Roofing LLC in any of these ways:
- By giving verbal consent during a conversation with our representative.
- By submitting a consent form through our website.
- By completing a paper form during a service consultation.
6.5 How to opt out
You can opt out of SMS messages at any time by replying “STOP” to any message you receive. You may also contact Icon Roofing directly to be removed from our messaging list. For assistance, reply “HELP.”
6.6 Charges and fees
Standard message and data rates may apply according to your carrier’s pricing plan. You are responsible for any costs or fees associated with SMS usage.
7. Governing law and jurisdiction
Arizona law governs these Terms and Conditions regardless of conflict of law rules, except where specifically stated otherwise. The Customer agrees that, in the event of litigation, jurisdiction and venue are proper in Maricopa County Superior Court or the United States District Court for the District of Arizona. The Customer further agrees that, in the event of a dispute, the prevailing party is entitled to its attorney fees and recoverable costs.
8. Severability
If a court, mediator or arbitrator holds any provision of these Terms and Conditions to be unenforceable, all other provisions remain in full force.
9. Indemnification
The Customer agrees to save and hold Icon harmless from any claims, demands, liabilities, costs, expenses or judgments arising in whole or in part, directly or indirectly, from the negligence or lack of care of the Customer or the Customer’s customers, agents, employees or invitees involving the use of any product or service supplied by Icon. This indemnification includes all costs, attorney fees and other expenses paid or incurred by or imposed on Icon in connection with the defense of any indemnity claim.
